The following terms and conditions exclusively govern any orders placed or products ordered or purchased through this website.
Please, read this contract carefully as the products are offered conditional upon acceptance, without modification, of the terms.
If you do not accept these terms, do not place orders or purchase products from our company.
Seller makes no representations or warranties regarding the Goods sold. SELLER DISCLAIMS ANY WARRANTY RESPECTING THE MERCHANTABILITY OF THE GOODS SOLD TO BUYER OR THEIR FITNESS FOR ANY PARTICULAR PURPOSE OR USE. Seller is an authorized distributor of the Original Component Manufacturer (“OCM”) goods. As such, Seller agrees to transfer to Buyer those transferable warranties Seller receives from the OCM for the goods sold to Buyer and is in accordance with the applicable OCM specifications. The warranties set forth herein shall not apply to any goods that: 1) that have not been kept in a controlled environment which reasonably limits damage resulting from heat, humidity, corrosion, contamination and/or electrostatic discharge for normal storage and prescribed maintenance:2) have been subject to an accident, excessive stress, modification, or abnormal wear and tear; and, Value-added work performed by Seller will conform to applicable Buyer’s specifications relating to such work.
Seller’s liability arising out of any sale of goods to Buyer is expressly limited to either: 1) refund of the purchase price paid by the Buyer for such goods (without interest); or 2) repair and/ or replacement of such goods at Seller’s election, and such remedies shall be exclusive and in lieu of all others. In no event shall Seller be liable for indirect, special, incidental or consequential damages of any nature, including, but not limited to, loss of profit, promotional or manufacturing expenses, overhead, injury to reputation or loss of customers, personal injury or property damage. Buyer’s recovery from Seller for any claim shall not exceed the purchase price paid by Buyer for the goods, irrespective of the nature of the claim, whether in warranty, contract or otherwise.
Minimum order is $100.00.
All orders placed by you the buyer are subject to acceptance by seller.
Orders may not be cancelled without the seller’s prior written consent. If a product can not be shipped within 30 days of order, the seller will notify buyer and allow buyer to cancel the order.
Some products may not be available to ship outside the U.S.
Seller may refuse service, may cancel orders at any time without notice.
The prices of the products are those specified on this website and are quoted in U.S. dollars.
All prices quoted are exclusive of transportation and insurance cost, duties and all taxes including, but not limited to, federal, state, provincial and local sales, excise, goods and services and value added taxes and any other taxes. Buyer agrees to pay these taxes unless buyer has provided seller with an exemption resale certificate number for the location where the product is to be shipped. Unless the sales is otherwise exempt from these taxes. Buyer agrees to indemnify and hold seller harmless for any liability for tax in connection with the sale, as well as the collection or withholding thereof, including penalties and interest thereon. When applicable, transportation and taxes shall appear as separate items on seller’s invoice.
Normal credit terms as NET 30 days based on the receipt of credit references.
Credit references must include bank information and three trade references in the electrinic industry.
We accept American Express, Master Card, Visa and Discover. We do not store credit card information. Your credit card information will be transferred via secure SSL connection to Authorize.Net payment gateway.
Sales tax: orders shipped to an address in New York state must pay New York state sales tax, unless we have a New York state resale number on your order. If you are required to pay sales tax in your state, that is your responsibility.
Before we ship an international order you must meet the following requirements:
You must provide us with a account number to bill for shipping.
You must provide a valid street address as UPS does not deliver to post office boxes and a valid postal code for the country of delivery.
If you have need to use an alternate method of shipping please contact our sales department and advise the method you would like to use and a shipping account number to be billed. If this carrier is acceptable then we will use your preferred method of shipping.
Products sold under these terms and conditions will be subject to export control laws, restrictions, and regulations of the United Sates of America. Customer agrees to comply with all applicable export laws, restrictions and regulations of the U.S. Certain products may be prohibited from export. Customer must represent that he is not prohibited by law to purchase product. Customer shall be responsible to obtain any license to export, re-export, or import as is required.
Products sold by seller are not designed, intended or authorized for use in life support, life sustaining, nuclear, or other applications in which the failure of such products could reasonably be expected to result in personal injury, loss of life or catastrophic property damage. If buyer uses or sells the products for use in any such applications: (1) buyer acknowledges that such use or sale is at buyer's sole risk; (2) buyer agrees that seller and the manufacturer of the products are not liable, in whole or in part, for any claim or damage arising from such use; and (3) buyer agrees to indemnify, defend and hold seller and the manufacturer of the products harmless from and against any and all claims, damages, losses, costs, expenses and liabilities arising our of or in connection with such use or sale, including reasonable attorneys fees.
Manufacturer warrantees on products sold only. No warranties extended by the seller beyond manufacturer warranties. End user is responsible for all installation and use in accordance with manufacturer’s instructions. Seller is not liable for any special, incidental, or consequential damages including, but not limited to, damages resulting from loss of profit or revenue, recall costs, claims for service interruptions or failure to supply downtime testing, installations or removal costs, costs of substitute products, property damage, personal injury, death, or legal expenses.
Shipments will be deemed to have been accepted by buyer upon delivery of the said shipments to buyer unless rejected upon receipt. Buyer shall perform whatever inspection or tests buyer deems necessary as promptly as possible but in no event later that five (5) days after delivery. Any discrepancy in shipment quantity must be reported within five (5) working days of receipt of product.
All returns require a Return Authorization number. Please note that a Return Authorization number (which is valid for 15 days) does not guarantee final approval. All returns are subject to inspection and verification prior to the final decision.
All returns/exchanges must be in factory condition, including all original packaging material. Pack the products into a shipping box with plenty of packing material, and tape securely, write the Return Authorization number issued clearly on the outside of the shipping carton and include a copy of your invoice.
Any merchandise returned to us unauthorized will be refused.
Merchandise should be returned within 20 days of receipt of invoice.
We do not accept any return merchandise on any order shipped outside the U.S.A.
Please ship your parcel back to us freight prepaid. We suggest that you use UPS Ground service “insured”. Sorry we cannot accept COD or Freight Collect shipments.
No goods will be accepted for exchange or return without authorization.
